Terms and conditions

1. Definitions and applicability

TT Verduurzaming (Chamber of Commerce number: 42088537), based in Mijdrecht, is the contractor. The customer is the natural or legal person who accepts a quote or order from TT Verduurzaming. These terms apply to all quotes, agreements and work by TT Verduurzaming, such as advice, supply and installation of heat pumps, solar panels, home batteries and charging stations, and to service and maintenance.

Nothing in these terms limits the mandatory statutory rights of consumers.

2. Quotes and formation of the agreement

A quote is non-binding and valid for the period stated in it. An agreement is formed once the customer has accepted the quote in writing or digitally. Prices for consumers include VAT unless stated otherwise. "From" prices on the website are indications, not offers.

3. Performance and planning

TT Verduurzaming performs the work to the best of its knowledge and ability and according to the customary rules of the trade. Stated delivery times and schedules are indicative unless agreed otherwise in writing. In case of delay, the customer can give TT Verduurzaming written notice of default and a reasonable period to perform.

4. Customer cooperation

The customer ensures the work location is accessible in time and safely, that the information TT Verduurzaming needs is correct (such as photos of the meter cupboard) and that permission is obtained where needed, for example from a landlord or homeowners' association. If it turns out during the work that the situation differs from what was provided, this may lead to a change in planning or price.

5. Additional work and changes

Work not included in the quote that turns out to be necessary or desired is only carried out after consultation with the customer. Additional work is invoiced separately.

6. Payment

Payment is due within 14 days of the invoice date unless agreed otherwise. For larger orders, payment in instalments may be agreed as stated in the quote. In case of late payment, the customer is in default and statutory interest and reasonable collection costs may be charged, subject to statutory rules for consumers.

7. Right of withdrawal

If a consumer concludes a distance agreement, the statutory 14-day right of withdrawal may apply. This right has statutory exceptions, such as for products or services made or adjusted to the customer's specifications, and for services that have started with the customer's explicit consent. TT Verduurzaming informs the customer about this before the agreement.

8. Delivery, warranty and complaints

After completion of the work the installation is handed over and explained. The manufacturer's warranty applies to supplied products. For installation work, the warranty stated in the quote applies. Not following the manufacturer's instructions for use or maintenance requirements may affect the warranty. The customer reports complaints as soon as possible, in any case within a reasonable period after discovering, or reasonably being able to discover, the defect, preferably via info@ttverduurzaming.nl.

9. Subsidies

The customer remains responsible for applying for subsidies (such as the ISDE) unless agreed otherwise in writing. TT Verduurzaming does not guarantee that a subsidy is granted; conditions and amounts are set by the subsidy provider and can change.

10. Liability

The liability of TT Verduurzaming is limited to direct damage and to a maximum of the amount paid out under its business liability insurance in the case concerned or, if no payout is made, to the invoice value of the order. TT Verduurzaming is not liable for indirect damage such as lost profit or missed savings. These limitations do not apply in case of intent or deliberate recklessness, nor to the extent the law mandatorily prohibits it.

11. Yield and savings

Stated yields, savings and payback times are indications based on the data and assumptions available at the time, such as consumption, energy prices and regulations. No rights can be derived from them.

12. Privacy

TT Verduurzaming processes personal data in accordance with the privacy policy.

13. Governing law and disputes

Dutch law applies to all agreements. Disputes are submitted to the competent court in the Netherlands, without prejudice to the right of consumers to turn to the court of their place of residence.
